A empresa alegava que as cr\u00edticas configurariam afronta aos seus direitos da personalidade e pedia, ainda, indeniza\u00e7\u00e3o por danos morais por parte da plataforma.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;A relatora do recurso, desembargadora Marcia Dalla D\u00e9a Barone, afirmou em seu voto que os coment\u00e1rios n\u00e3o atingiram os direitos da personalidade do autor, uma vez que os usu\u00e1rios do site \u201cse valeram do direito de manifesta\u00e7\u00e3o e liberdade de express\u00e3o, emitindo somente a sua opini\u00e3o acerca da qualidade dos servi\u00e7os prestados pelo autor\u201d. A magistrada ainda destacou que o site, em seu sistema, garante \u00e0s empresas criticadas o direito de resposta \u00e0s reclama\u00e7\u00f5es e, dessa forma, n\u00e3o h\u00e1 ato il\u00edcito, sendo incab\u00edvel a retirada do conte\u00fado e o pagamento de indeniza\u00e7\u00e3o.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\u201cA mera publica\u00e7\u00e3o de cr\u00edticas aos servi\u00e7os prestados pelo autor na rede mundial de computadores, por si s\u00f3, n\u00e3o configura situa\u00e7\u00e3o excepcional a ensejar ang\u00fastia, frustra\u00e7\u00e3o e sofrimento que extrapole o simples dissabor da vida cotidiana\u201d, finalizou a desembargadora.<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;Participaram do julgamento da apela\u00e7\u00e3o, ocorrido no \u00faltimo dia 19, os desembargadores Jos\u00e9 Carlos Ferreira Alves e Jos\u00e9 Joaquim dos Santos.
