Al\u00e9m disso, a Anvisa j\u00e1 havia anunciado, na quinta-feira (6), a revoga\u00e7\u00e3o de medida relacionada \u00e0 Shopee.<\/p>\n<p>Entretanto, a decis\u00e3o n\u00e3o representa uma autoriza\u00e7\u00e3o autom\u00e1tica para a venda de medicamentos pelas plataformas. A pr\u00f3pria Anvisa esclareceu que ainda ser\u00e1 necess\u00e1ria regulamenta\u00e7\u00e3o espec\u00edfica.<\/p>\n<h4>O que mudou para as plataformas<\/h4>\n<p>As novas resolu\u00e7\u00f5es retiram medidas preventivas que impediam determinadas atividades relacionadas a medicamentos nos ambientes digitais.<\/p>\n<p>No caso do iFood e do Rappi, foram revogadas as proibi\u00e7\u00f5es relacionadas \u00e0 comercializa\u00e7\u00e3o, distribui\u00e7\u00e3o e propaganda de medicamentos.<\/p>\n<p>J\u00e1 para o Mercado Livre e a Americanas, a Anvisa retirou as proibi\u00e7\u00f5es de comercializa\u00e7\u00e3o e propaganda.<\/p>\n<p>A ag\u00eancia tamb\u00e9m incluiu a Shopee entre as plataformas alcan\u00e7adas pelas atualiza\u00e7\u00f5es regulat\u00f3rias.<\/p>\n<h4><strong>Lei permite contrata\u00e7\u00e3o de plataformas para entregas<\/strong><\/h4>\n<p>A mudan\u00e7a est\u00e1 relacionada \u00e0 Lei n\u00ba 15.357\/2026, que alterou a Lei n\u00ba 5.991\/1973.<\/p>\n<p>A legisla\u00e7\u00e3o passou a estabelecer que farm\u00e1cias e drogarias licenciadas podem contratar canais digitais e plataformas de com\u00e9rcio eletr\u00f4nico para log\u00edstica e entrega de medicamentos.<\/p>\n<p>Por\u00e9m, essa possibilidade est\u00e1 condicionada ao cumprimento integral da regulamenta\u00e7\u00e3o sanit\u00e1ria aplic\u00e1vel.<\/p>\n<p>Portanto, a decis\u00e3o cria espa\u00e7o jur\u00eddico para a participa\u00e7\u00e3o das plataformas na log\u00edstica, mas n\u00e3o elimina as exig\u00eancias sanit\u00e1rias existentes.<\/p>\n<h4><strong>Anvisa faz alerta sobre a decis\u00e3o<\/strong><\/h4>\n<p>Em comunicado publicado nesta segunda-feira, a Anvisa destacou que a revoga\u00e7\u00e3o das medidas preventivas n\u00e3o significa autoriza\u00e7\u00e3o autom\u00e1tica para a comercializa\u00e7\u00e3o de produtos farmac\u00eauticos.<\/p>\n<p>Segundo a ag\u00eancia, a aplica\u00e7\u00e3o do dispositivo da Lei n\u00ba 5.991\/1973 ainda depende de uma regulamenta\u00e7\u00e3o que ser\u00e1 editada pela pr\u00f3pria Anvisa.<\/p>\n<p>Dessa forma, farm\u00e1cias, drogarias e plataformas digitais dever\u00e3o observar as regras sanit\u00e1rias que ser\u00e3o estabelecidas pela ag\u00eancia.<\/p>\n<h4><strong>Plataformas passam a ter papel maior na entrega<\/strong><\/h4>\n<p>A altera\u00e7\u00e3o abre espa\u00e7o para que grandes plataformas digitais participem de opera\u00e7\u00f5es de log\u00edstica e entrega de medicamentos.<\/p>\n<p>Esse movimento pode ampliar a conveni\u00eancia para consumidores e criar novas possibilidades de integra\u00e7\u00e3o entre farm\u00e1cias, com\u00e9rcio eletr\u00f4nico e servi\u00e7os de entrega.<\/p>\n<p>Contudo, a responsabilidade pelo cumprimento das regras sanit\u00e1rias permanece como ponto central da opera\u00e7\u00e3o.<\/p>\n<p>A legisla\u00e7\u00e3o tamb\u00e9m mant\u00e9m a dispensa\u00e7\u00e3o de medicamentos vinculada aos estabelecimentos autorizados.
