O magistrado designou a Preserva-A\u00e7\u00e3o Administra\u00e7\u00e3o Judicial e o Escrit\u00f3rio de Advocacia Zveiter para exercerem a administra\u00e7\u00e3o judicial do processamento.<\/p>\n<p><iframe title=\"Spotify Embed: Americanas carrega R$ 43 bi de d\u00edvidas em recupera\u00e7\u00e3o judicial; Fundos de Investimentos s\u00e3o afetados com a crise\" style=\"border-radius: 12px\" width=\"100%\" height=\"152\" frameborder=\"0\" allowfullscreen allow=\"autoplay; clipboard-write; encrypted-media; fullscreen; picture-in-picture\" loading=\"lazy\" src=\"https:\/\/open.spotify.com\/embed\/episode\/1pTTWlNkl7MvSRsXrk6uVt?si=TAR4f5zhQWyXdzZ1kLNPjg&#038;utm_source=oembed\"><\/iframe><\/p>\n<p>Com a decis\u00e3o, ficam suspensas todas as execu\u00e7\u00f5es financeiras contra o Grupo Americanas.<\/p>\n<p>\u201cSuspendo todas as a\u00e7\u00f5es e execu\u00e7\u00f5es contra as requerentes, na forma do art. 6\u00ba da Lei 11.101\/2005, permanecendo os respectivos autos no ju\u00edzo onde se processam, ressalvadas as a\u00e7\u00f5es previstas nos \u00a7\u00a7 1\u00ba, 2\u00ba e 7\u00ba do art. 6\u00ba da Lei e as relativas a cr\u00e9ditos excetuados na forma dos \u00a7\u00a7 3\u00ba e 4\u00ba do art. 49 da Lei 11.101\/2005. Observando-se, ainda, as exce\u00e7\u00f5es expressas no artigo 193-A, do mesmo diploma, sendo para tanto considerada a data de ajuizamento da medida cautelar que antecedeu ao presente pedido.\u201d<\/p>\n<p>O magistrado ressaltou que segue vigente a decis\u00e3o liminar concedida, antes do pedido de recupera\u00e7\u00e3o judicial apresentado pelo Grupo Americanas, ressalvada a decis\u00e3o de concess\u00e3o do Mandado de Seguran\u00e7a apresentado pelo credor Banco BTG Pactual.<\/p>\n<p>\u201cConfirmo integralmente a liminar concedida cautelarmente na decis\u00e3o constante do index 42086539, determinando que: (a) sejam suspensas todas as a\u00e7\u00f5es e execu\u00e7\u00f5es existentes contra as Requerentes, bem como a exigibilidade dos cr\u00e9ditos concursais; (b) sejam sobrestados os efeitos de toda e qualquer cl\u00e1usula que imponha vencimento antecipado das d\u00edvidas das Requerentes, em decorr\u00eancia do fato relevante publicado em 11.1.2023, inclusive como medida de isonomia para a coletividade de credores e respeito a par conditio creditorum; (c) sejam suspensas ordens de arresto, penhora, sequestro, busca e apreens\u00e3o e constri\u00e7\u00e3o sobre os bens, oriundas de demandas judiciais ou extrajudiciais, o que dever\u00e1 ser previamente submetido a este Ju\u00edzo, sobretudo se puderem prejudicar ou inviabilizar o processo de recupera\u00e7\u00e3o judicial das Requerentes; e (d) a proibi\u00e7\u00e3o de compensa\u00e7\u00e3o de quaisquer valores, com a imediata restitui\u00e7\u00e3o de todo e qualquer valor que os credores eventualmente tiverem compensado, devendo ser observadas integralmente todas as decis\u00f5es superiores proferidas em sede de recurso interposto por credores, notadamente a liminar concedida no Mandado de Seguran\u00e7a n\u00ba 0001758-09.2023.8.19.0000.\u201d<\/p>\n<p>O pedido de recupera\u00e7\u00e3o judicial foi apresentado pelo Grupo Americanas que divulgou ter constatado inconsist\u00eancias cont\u00e1beis, referentes aos exerc\u00edcios anteriores do grupo, incluindo o ano de 2022, podendo refletir o montante aproximado de R$ 20 bilh\u00f5es. O grupo alegou que tais inconsist\u00eancias exigir\u00e3o reajustes nos lan\u00e7amentos da Companhia, o que poder\u00e1 impactar nos resultados finais divulgados nos respectivos exerc\u00edcios anteriores, com altera\u00e7\u00e3o do grau de endividamento da empresa e\/ou volume de capital de giro, implicando, por via reflexa, no descumprimento de contratos, inclusive estrangeiros, acarretando o vencimento antecipado e imediato de d\u00edvidas no montante de R$ 40 bilh\u00f5es.<\/p>\n<p>\u201cCom efeito, trata-se de uma das maiores e mais relevantes recupera\u00e7\u00f5es judiciais ajuizadas at\u00e9 o momento no pa\u00eds, n\u00e3o s\u00f3 por conta do seu passivo, mas por toda a repercuss\u00e3o de mercado que a situa\u00e7\u00e3o de crise das requerentes vem provocando e, por todo o aspecto social envolvido, dado o vultoso n\u00famero de credores, de empregados diretos e indiretos dependentes da atividade empresarial ora tutelada, bem como o relevante volume de riqueza e tributos gerados.\u201d<\/p>\n<p>O magistrado chamou a aten\u00e7\u00e3o sobre as consequ\u00eancias de uma eventual quebra do Grupo Americanas, n\u00e3o somente para o setor financeiro, como para a pr\u00f3pria popula\u00e7\u00e3o.<\/p>\n<p>\u201cComo pontuado no requerimento de Recupera\u00e7\u00e3o Judicial, a eventual quebra do Grupo Americanas pode acarretar o colapso da cadeia de produ\u00e7\u00e3o do Brasil, com preju\u00edzos em relevantes setores econ\u00f4micos, afetando mais de 50 milh\u00f5es de consumidores, colocando em risco dezenas de milhares de empregos.\u201d<\/p>\n<p>Ainda segundo a decis\u00e3o, o \u201cJu\u00edzo est\u00e1 ciente das quest\u00f5es que j\u00e1 v\u00eam sendo debatidas nestes autos e em recursos, por parte de credores detentores de expressivo relevo econ\u00f4mico, notadamente em rela\u00e7\u00e3o \u00e0s alega\u00e7\u00f5es de fraude e m\u00e1-f\u00e9, que dever\u00e3o ser<\/p>\n<p>apuradas em sede pr\u00f3pria para a identifica\u00e7\u00e3o dos seus eventuais respons\u00e1veis.
