A decis\u00e3o vigorar\u00e1 enquanto a empresa n\u00e3o demonstrar o cumprimento de a\u00e7\u00f5es corretivas como reacomoda\u00e7\u00e3o de passageiros, reembolso integral da passagem a\u00e9rea aos consumidores que optaram por esta alternativa e resposta aos passageiros sobre todas as reclama\u00e7\u00f5es registradas na plataforma <a class=\"external-link\" title=\"\" href=\"http:\/\/consumidor.gov.br\/\" target=\"_blank\" rel=\"noopener\" data-tippreview-enabled=\"false\" data-tippreview-image=\"\" data-tippreview-title=\"\">Consumidor.gov.br<\/a>\u00a0(clique no link para acessar), inclusive aquelas cujo prazo de 10 dias tenha sido descumprido pela empresa.<\/p>\n<p>A nova decis\u00e3o da Ag\u00eancia soma-se \u00e0 suspens\u00e3o do Certificado de Operador A\u00e9reo (COA) e \u00e0 imediata suspens\u00e3o da venda de passagens, adotadas pela ANAC em 17 de dezembro, data em que a Itapemirim anunciou a interrup\u00e7\u00e3o de suas opera\u00e7\u00f5es. A nova medida cautelar aplicada \u00e0 empresa decorre das a\u00e7\u00f5es permanentes de fiscaliza\u00e7\u00e3o em \u00e2mbito coletivo exercidas pela ANAC e s\u00f3 ser\u00e1 revogada ap\u00f3s comprova\u00e7\u00e3o do cumprimento integral de todas as obriga\u00e7\u00f5es estabelecidas na\u00a0<a class=\"external-link\" title=\"\" href=\"https:\/\/www.anac.gov.br\/assuntos\/legislacao\/legislacao-1\/resolucoes\/resolucoes-2016\/resolucao-no-400-13-12-2016\" target=\"_blank\" rel=\"noopener\" data-tippreview-enabled=\"false\" data-tippreview-image=\"\" data-tippreview-title=\"\">Resolu\u00e7\u00e3o ANAC n\u00ba 400\/2016<\/a>\u00a0(clique no link para acessar).<\/p>\n<p>Em rela\u00e7\u00e3o \u00e0 reacomoda\u00e7\u00e3o de passageiros lesados pela interrup\u00e7\u00e3o abrupta das opera\u00e7\u00f5es da Itapemirim, a empresa dever\u00e1 comprovar o oferecimento de alternativas de reacomoda\u00e7\u00e3o em voo de outras companhias, de execu\u00e7\u00e3o do servi\u00e7o por outra modalidade de transporte ou de reembolso integral, para a escolha do consumidor. A companhia dever\u00e1 ainda demonstrar a realiza\u00e7\u00e3o de quaisquer outros reembolsos devidos ao consumidor em decorr\u00eancia de descumprimento contratual verificado desde o in\u00edcio da comercializa\u00e7\u00e3o das passagens a\u00e9reas.<\/p>\n<p>Em rela\u00e7\u00e3o \u00e0s reclama\u00e7\u00f5es dos consumidores que tenham sido registradas ou que ainda venham a ser registradas na plataforma\u00a0<a class=\"external-link\" title=\"\" href=\"http:\/\/consumidor.gov.br\/\" target=\"_blank\" rel=\"noopener\" data-tippreview-enabled=\"false\" data-tippreview-image=\"\" data-tippreview-title=\"\">Consumidor.gov.br<\/a>, a Itapemirim dever\u00e1 comprovar a resposta ao consumidor, observado o prazo de 10 dias contados da data de registro de cada reclama\u00e7\u00e3o.
